Agreement Overview
These Terms of Service ("Terms") govern your use of the Premier Restoration Services of Long Island website and the restoration services we provide. By using our website or hiring us for restoration work, you agree to these Terms. Please read them carefully. If you have questions, call us at (631) 573-6354 and we will be happy to explain anything.
Services We Provide
Premier Restoration Services of Long Island provides water damage restoration, fire and smoke damage restoration, wind and storm damage restoration, mold remediation, flood cleanup, and related reconstruction services for residential and commercial properties throughout Long Island, New York. We offer 24/7 emergency response to help property owners recover from unexpected damage events.
Emergency Services
We are available 24 hours a day, 7 days a week, 365 days a year for emergency restoration calls. However, please understand the following:
- Response times depend on current demand, weather conditions, crew availability, and your location on Long Island. While we make every effort to respond as quickly as possible, we cannot guarantee a specific arrival time.
- During major storms or widespread disaster events, demand may exceed our capacity. We prioritize calls based on the severity and safety risk of each situation.
- Emergency mitigation work (such as water extraction, tarping, or board-up) is performed to prevent further damage. Full restoration is typically scheduled as a separate phase of work.
Estimates and Pricing
We provide free estimates for restoration work. Here is what you should know about our pricing:
- Estimates are not binding contracts. An estimate represents our best assessment based on the visible damage at the time of inspection. Hidden damage, such as water behind walls or structural issues concealed by finishes, may not be apparent until work begins.
- Final pricing may vary from the original estimate if additional damage is discovered, if the scope of work changes at your request, or if material costs change significantly.
- We will communicate with you before proceeding with any work that would significantly exceed the original estimate. No surprise charges.
- Emergency mitigation work may begin before a full estimate can be prepared, because time-sensitive action is often needed to prevent further damage. We will provide pricing information as soon as reasonably possible.
Insurance Claims
Many of our customers file insurance claims for restoration work. We are happy to assist with the claims process, including:
- Documenting damage with photos and detailed reports.
- Providing itemized estimates in formats insurance companies accept.
- Communicating directly with your insurance adjuster when authorized.
- Supplementing claims when additional damage is discovered.
However, please understand that you, the property owner, are ultimately responsible for payment regardless of your insurance claim outcome. We are not a party to your insurance contract. If your insurance company denies a claim, reduces a payout, or delays payment, you remain responsible for the cost of services rendered. We will work with you, but we cannot guarantee any insurance outcome.
Property Access and Authorization
By hiring us to perform restoration work, you authorize our team and any subcontractors to access your property as needed to complete the agreed-upon work. You represent that you have the legal authority to grant this access, whether as the property owner, authorized tenant, or property manager.
We will treat your property with care and respect. If we need access when you are not present, we will arrange this with you in advance. For emergency board-up or tarping services requested remotely, you authorize us to access the exterior of the property as needed to secure it.
Liability Limitations
We carry appropriate insurance and licensing for the work we perform. That said:
- Our liability for any claim arising from our services is limited to the amount you paid for those specific services.
- We are not liable for pre-existing damage, damage caused by ongoing leaks or conditions you were aware of, or damage that occurs after our work is complete due to unrelated causes.
- We are not responsible for the loss of personal property unless it is directly caused by our negligence. We recommend removing or securing valuables before restoration work begins.
- We are not liable for delays or inability to perform services caused by circumstances beyond our reasonable control (see Force Majeure below).
Payment Terms
- For insurance-covered work, payment is expected when you receive your insurance payout. We may require assignment of benefits or a direction-to-pay authorization.
- For out-of-pocket work, we may require a deposit before starting and progress payments during longer projects.
- Final payment is due upon completion of work unless other arrangements have been made in writing.
- We accept checks, credit cards, and bank transfers.
- Invoices unpaid for more than 30 days may incur a late fee of 1.5% per month, or the maximum rate allowed by New York State law, whichever is less.
Cancellation Policy
You may cancel scheduled restoration work at any time before work begins at no charge. If work has already started:
- You will be responsible for paying for all work completed up to the point of cancellation, plus the cost of any materials already purchased or ordered for your project.
- Emergency mitigation work (water extraction, board-up, tarping) that has already been performed is non-refundable, as it was necessary to protect your property.
Warranty on Work
We stand behind the quality of our work. Restoration services performed by Premier Restoration Services of Long Island come with a workmanship warranty. If an issue arises that is directly related to the quality of our work, contact us and we will address it promptly. This warranty does not cover:
- Damage from new or recurring water, fire, or storm events.
- Normal wear and tear.
- Issues caused by modifications made by others after our work is complete.
- Pre-existing conditions that were documented before work began.
Specific warranty terms and duration will be outlined in your project agreement.
Force Majeure
We are not liable for failure or delay in performing services due to events beyond our reasonable control, including but not limited to: natural disasters, severe weather, pandemics, government orders, material shortages, utility outages, or labor disruptions. In such cases, we will resume services as soon as reasonably possible and keep you informed.
